2. Eligibility and Account Requirements

You may use our Services to:

• Create AI-generated videos, images, and content for legitimate purposes
• Transcribe audio and video content you own or have rights to process
• Analyze data and generate insights for business purposes
• Integrate our APIs into your applications (subject to API terms)

3.2 Prohibited Uses

You agree NOT to use our Services for:

Content Restrictions:

• Upload illegal, harmful, defamatory, obscene, or inappropriate content
• Generate deepfakes, impersonation content, or misleading media
• Create or disseminate misinformation or propaganda
• Upload media containing people without consent or minors
• Process content violating intellectual property rights

Technical Restrictions:

• Reverse engineer, decompile, or attempt to derive source code
• Bypass security measures or access controls
• Use unauthorized automated tools
• Attempt unauthorized access to systems or accounts
• Upload malicious code, viruses, or harmful software

Commercial Restrictions:

• Resell or redistribute Services without permission
• Use Services to compete directly with our business
• Exceed rate limits or usage quotas
• Use for cryptocurrency mining or resource-intensive activities

3.3 Media Upload Agreement

By uploading content, you confirm that:

• You have all necessary rights and permissions to the content
• You will not upload violent, explicit, or illegal material
• You understand misuse may result in account termination without refund
• You agree to use our tools creatively and respectfully

4. User Content and Intellectual Property

4.1 Your Content Ownership

• You retain ownership of all content you submit to our Services
• You are solely responsible for content you create, upload, and share
• We do not endorse or take responsibility for user-generated content

4.2 License to Process Your Content

By using our Services, you grant dFusionX:

• A non-exclusive, worldwide, royalty-free license to use, process, store, and display your content solely to provide the Services
• Right to process your content through third-party AI models and services
• Permission to temporarily store your content for processing and service delivery

4.3 Model Improvement (Optional)

• By default: We do NOT use your content to train our foundation AI models
• Opt-in only: You may choose to help improve our models through account settings
• Revokable: You may revoke this consent at any time

4.4 Our Intellectual Property

All intellectual property rights in our Services are owned by or licensed to dFusionX, including:

• Software, AI models, designs, and branding
• Features, documentation, and trademarks
• No rights granted except as expressly stated in these Terms

5. Subscriptions, Fees, and Payments

5.1 Pricing and Billing

• Fees billed according to selected plan
• Subscription fees charged in advance
• Pay-per-use based on actual usage
• All fees are non-refundable except where required by law

5.2 Payment Processing

• Processed through secure third-party providers
• We don't store full credit card numbers
• You're responsible for applicable taxes
• Failed payments may result in suspension

5.3 Auto-Renewal

• Subscriptions renew automatically
• Cancel anytime through account settings
• Cancellations effective at billing period end
• Enterprise customers may have different terms

5.4 Free Trials

• Offered at our discretion with limitations
• Promotional pricing may change
• Valid payment info required
• Charged upon trial expiration unless canceled

6. AI Technology and Service Disclaimers

Important AI Limitations

• AI-generated outputs are not guaranteed to be accurate, appropriate, or safe
• Generated content may be unexpected, inaccurate, biased, or reflect training data limitations
• You are solely responsible for reviewing AI outputs before use
• You must ensure compliance with applicable laws when using AI-generated content

Technology Limitations

AI technology is rapidly evolving and may have inherent limitations and dependencies on third-party models.

User Responsibility

You must fact-check and verify accuracy of generated content before use or distribution.

Safety Measures

We implement content filters and safety measures, but no automated system is 100% accurate.

7. Third-Party Services and Integrations

Cloud Hosting: Google Firebase, Google Cloud

Payments: RevenueCat, Stripe

• Fail to pay fees when due
• Abuse Services or impact other users

Effect of Termination

• Right to use Services immediately ceases
• We may delete account and data per retention schedule
• Outstanding fees remain due and payable

11. Limitation of Liability

LIABILITY CAP

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DFUSIONX'S TOTAL LIABILITY FOR ALL CLAIMS IN ANY 12-MONTH PERIOD WILL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICES DURING THAT PERIOD.

EXCLUDED DAMAGES
